1. Acceptance of the Agreement

By accessing, downloading, or using the EYS Play mobile application (the "App"), you agree to comply with and be bound by these Terms and Conditions. This agreement is a legal contract between you and EYS Play. If you do not agree to these terms, you are prohibited from using the App and must delete it from your device immediately.

2. Eligibility and User Responsibility

• Age Requirement: Users under the age of 18 must have the explicit consent of a parent or legal guardian to use the App. We encourage parents to supervise their children's digital and physical sports activities.
• Account Accuracy: You agree to provide true, current, and complete information. You are solely responsible for all activities that occur under your account and for maintaining the security of your password.

3. Nature of Service: The "Facilitator" Role

EYS Play is a technology platform that connects sports seekers with sports organizations, businesses, and coaches.

• No Endorsement: EYS Play does not own, operate, or manage the teams, clubs, or businesses listed. A listing on our App does not constitute an endorsement of that organization's safety, quality, or legal standing.
• Interaction Risk: Users acknowledge that participating in sports carries inherent risks. EYS Play is not responsible for any physical injury, health issues, or property damage occurring during activities discovered through the App.

4. Use of Location Data and Map Search

Our "Powerful Map Search" requires access to your device's location data.

• Accuracy: While we strive for precision, we do not guarantee the accuracy of map data or the real-time location of sports facilities.
• Privacy: Use of location data is governed by our Privacy Policy. By using the Map Search, you consent to the processing of your geographical information to provide relevant local results.

5. Open Registrations and Financial Transactions

• Third-Party Payments: If registrations are paid through the App, EYS Play may use third-party payment processors. You agree to abide by their terms of service as well.
• Refunds and Cancellations: EYS Play is generally not responsible for issuing refunds for team registrations. Refund requests must be directed to the specific sports organization or business. We are not liable for the financial insolvency of any listed business.

6. User-Generated Content and Reviews

Users may post reviews and send messages. By doing so, you grant EYS Play a non-exclusive, royalty-free license to use, display, and distribute this content.

• Standards: Content must be honest and respectful. We strictly prohibit the posting of defamatory, obscene, or hateful language.
• Moderation: EYS Play reserves the right, but not the obligation, to monitor and remove content that we deem, in our sole discretion, to violate these terms.

7. Business and Organization Obligations

Organizations listing on EYS Play must:

• Maintain all necessary licenses, insurance, and safety certifications required by law.
• Provide accurate registration dates, pricing, and program details.
• Ensure that any "Open Registration" advertised is honored for users who meet the team criteria.

8. Prohibited Activities

You agree not to use the App for any unlawful purpose. Prohibited actions include:

• Data Mining: Using automated systems or software to extract data from the App for commercial purposes.
• Impersonation: Creating accounts for teams or businesses you do not legally represent.
• Harassment: Using in-app messaging to bully, threaten, or spam other users or coaches.

9. Intellectual Property Rights

The EYS Play name, logo, software code, and design elements are the exclusive property of EYS Play. You may not copy, modify, or reverse-engineer any part of the App without express written permission.

10. Termination of Use

We reserve the right to suspend or terminate your access to the App at any time, without notice, for any conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Disclaimer of Warranties

The App is provided on an "as-is" and "as-available" basis. EYS Play makes no warranties, expressed or implied, regarding the reliability of the App, the availability of sports teams, or the safety of any sports environment.

12. Limitation of Liability

To the maximum extent permitted by law, EYS Play and its affiliates shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or data, arising out of your use of the App or participation in any sports program discovered therein.

13. Changes to Terms

We may update these Terms and Conditions from time to time. Continued use of the App following any changes constitutes your acceptance of the new Terms.
